Terms of Service

Please read these Terms of Service carefully before using GetResort. By accessing or using our services, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using GetResort's services (“Services”), including our website, mobile applications, and any related services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you (“User”, “you”, or “your”) and GetResort (“Company”, “we”, “us”, or “our”).

Important: By using our Services as a guest at a hospitality property, you also agree to comply with the property's house rules and policies, which are provided separately.

2. Description of Services

GetResort provides a hospitality technology platform that enables:

  • Guest self-service ordering and booking of property services
  • In-room digital concierge and property information
  • Payment processing for services and amenities
  • Communication between guests and property staff
  • Guest preference management and personalization

Our Services are provided “as is” and we reserve the right to modify, suspend, or discontinue any aspect of the Services at any time with reasonable notice.

3. User Accounts and Registration

3.1 Account Creation

To access certain features, you may need to create an account or verify your identity through a booking code. You agree to provide accurate, current, and complete information during registration.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or use of your account.

3.3 Age Requirements

You must be at least 18 years old or the age of majority in your jurisdiction to create an account and use our Services. By using our Services, you represent that you meet this requirement.

3.4 Account Data

Your account data and personal information are processed in accordance with our Privacy Policy. You have the right to access, correct, and delete your account data as described therein.

4. Payments and Billing

4.1 Payment Processing

Payments are processed securely through our third-party payment processor (Stripe). By making a payment, you agree to Stripe's terms of service and authorize us to charge your selected payment method.

4.2 Pricing

All prices for services are displayed in the local currency of the property and include applicable taxes unless otherwise stated. Prices are set by individual properties and may change without notice.

4.3 Room Charges

If you choose to charge services to your room, you agree to settle the balance upon checkout according to the property's payment policies.

4.4 Refunds

Refund policies vary by property and service type. Cancellation and refund terms are displayed before you confirm any order. Generally:

  • Food and beverage orders may be cancelled before preparation begins
  • Service bookings may have specific cancellation windows
  • Digital services are typically non-refundable once delivered

4.5 Disputes

If you believe a charge is incorrect, please contact the property staff or our support team within 30 days of the transaction. We will investigate and resolve legitimate disputes promptly.

5. Acceptable Use Policy

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree NOT to:

Use the Services in any way that violates applicable laws or regulations

Attempt to gain unauthorized access to our systems or other users' accounts

Transmit any malware, viruses, or other malicious code

Interfere with or disrupt the integrity or performance of the Services

Use automated systems (bots, scrapers) to access the Services

Impersonate any person or entity or misrepresent your affiliation

Harass, abuse, or harm other users or property staff

Use the Services for any fraudulent or deceptive purposes

Circumvent any technical measures we use to provide the Services

We reserve the right to suspend or terminate your access to the Services if we reasonably believe you have violated these terms.

6. Intellectual Property

6.1 Our Property

The Services, including all content, features, and functionality (including but not limited to software, text, graphics, logos, and design), are owned by GetResort or its licensors and are protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use. This license does not include the right to:

  • Modify or copy the Services
  • Use any data mining, robots, or similar data gathering methods
  • Download any content (other than your own data exports)
  • Use the Services for any commercial purpose

6.3 User Content

Any content you submit through the Services (such as support messages or feedback) remains your property, but you grant us a license to use, store, and display such content as necessary to provide the Services.

7. Disclaimers

Important Notice

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Services will be uninterrupted, secure, or error-free
  • Results obtained from using the Services will be accurate or reliable
  • Any errors in the Services will be corrected
  • The Services will meet your specific requirements

Services provided by hospitality properties (food, amenities, experiences) are the responsibility of those properties. We are not liable for the quality, safety, or delivery of third-party services.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GETRESORT, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for all claims arising from or relating to the Services shall not exceed the amount you paid to us (if any) in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless GetResort and its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use or misuse of the Services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any content you submit through the Services

10. Termination

10.1 By You

You may terminate your account at any time by using the account deletion feature in your profile settings or by contacting us. Upon termination, your data will be handled according to our Privacy Policy.

10.2 By Us

We may suspend or terminate your access to the Services at any time, with or without cause, including for:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Non-payment of outstanding charges
  • Extended periods of inactivity
  • Requests from law enforcement or government agencies

10.3 Effect of Termination

Upon termination, your right to use the Services will immediately cease. Sections of these Terms that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, and indemnification provisions.

11. Dispute Resolution

11.1 Informal Resolution

Before initiating any formal dispute resolution, you agree to first contact us at legal@getresort.co to attempt to resolve the dispute informally. We will endeavor to resolve disputes within 30 days.

11.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable Member State laws, without regard to conflict of law principles.

11.3 Consumer Rights

If you are a consumer in the European Union, you have the right to bring proceedings before the courts of your country of residence. Nothing in these Terms affects your statutory consumer rights under applicable local law.

11.4 Online Dispute Resolution

The European Commission provides an Online Dispute Resolution platform, which you can access at ec.europa.eu/consumers/odr

12. General Provisions

12.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and GetResort regarding your use of the Services.

12.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

12.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.

12.5 Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the “Last updated” date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
